1. Agreement to terms

Benemens is a product operated by Tackon Technologies LLC ("Tackon Technologies," "Benemens," "we," "us"). These Terms of Service ("Terms") govern access to and use of the Benemens platform, including the giving page, donor portal, recurring giving, and organization dashboard (the "Platform"), by churches and nonprofits and their authorized staff ("Organization," "you"). By accessing or using the Platform, you agree to these Terms.

2. The Platform

Benemens provides online giving, donor management, recurring giving, and reporting tools for Organizations. Benemens is not a bank or a payment processor itself; card and payment processing is provided through our PCI-compliant payment processing partner.

3. Organization responsibilities

Organization is responsible for its own tax-exempt status, donor receipting, and any disclosures required by law in its jurisdiction.
Organization is responsible for the accuracy of information it provides, including staff invites and organization branding.
Organization will use the Platform only for lawful fundraising purposes and in accordance with any order form or agreement in place.

4. Security and compliance

Benemens maintains security controls described in our Privacy Policy, including authentication, authorization, encryption, and PCI DSS-aligned payment processing. Specific compliance commitments are set out in the applicable order form or agreement.

5. Availability and support

Service levels, uptime commitments, and support terms are defined in the applicable order form or agreement between Benemens and Organization, not in these Terms alone.

6. Fees

Fees, billing cycles, and payment processing rates are set out in the applicable order form. Fees are non-refundable except as expressly stated in that order form.

7. Intellectual property

Benemens retains all rights in the Platform. Organization retains all rights in its own data, branding, and Donor relationships.

8. Confidentiality

Each party will protect the other's confidential information with reasonable care and use it only to perform under these Terms and any related order form.

9. Limitation of liability

To the maximum extent permitted by law, neither party's liability arising out of these Terms will exceed the amounts paid by Organization to Benemens in the twelve months preceding the claim, except for liability arising from confidentiality breaches, data protection obligations, or indemnification.

10. Termination

Either party may terminate as set out in the applicable order form. Upon termination, Benemens will make Organization's data available for export for a reasonable transition period.

11. Changes to these terms

We may update these Terms from time to time. Material changes to an active agreement will be handled under the change process in the applicable order form or agreement.
